What is DUI?
Commonly called "drunk driving, "driving under the influence" (DUI) refers to operating a motor vehicle while
one's blood alcohol content (BAC) is above the legal limit set by statute, which supposedly is the level at which a
person cannot drive safely. Since May, 2007, all the state statutes are consistent and have set this limit at .08%
for adults who are at least 21 years old.

An individual can be also be charged with DUI if he or she operates a motor vehicle while under the influence of
any amount of drugs or alcohol, or a combination of the two, which makes the individual unable to safely operate
the vehicle that he or she is driving. This means that an adult can actually receive a DUI with a blood
alcohol concentration that is less than .08%
Why Do I Need a DUI Attorney?
Getting arrested for DUI can lead to embarrassment, anger, depression, and fear. Individuals from all walks of
life have been arrested for DUI. Remember that the more control you initiate in your life now, including educating
yourself about current DUI laws, the greater peace of mind you will most likely experience after your
DUI. Since you are in a vulnerable situation, you need to consult with a DUI lawyer you can trust.
Drunk driving is a very complex field with increasingly severe consequences. There is a minefield of complicated
constitutional, procedural, administrative, sentencing, evidentiary, and license issues. And all of these
issues are best addressed by a DUI lawyer.
Any DUI defense includes challenging the “stop and arrest” that was initiated by the police. Another
important area of DUI defense is getting the breath test results suppressed. Even if the breath test is not
suppressed, however, a DUI lawyer will be able to discount the results altogether. Recent legal challenges
that have led to “suppression” include the following:
- Defective warnings prior to conducting the test.
- Software problems in the testing machine.
- A constitutional challenge to the new DUI statute itself.
- A lack of calibration and certification of a thermometer in the testing machine.
